They're not mutually exclusive, but either way to be a sex offender you have to have committed a crime.

I imagine most comedians' personas are acts. Why?

You just seem to take Lee’s particularly to heart, which is odd if you acknowledge it’s an act. It’d be like someone calling our Al Murray for being a boorish prick because of his pub landlord routine.
